01The key dates

  1. 1Day 0: close on the saleProceeds go to a qualified intermediary, not to you.
  2. 2Day 45: identify replacement propertyIn writing, under the identification rules.
  3. 3Day 180: close on the replacementThe 45 days count inside the 180.

02The basics

  • Like-kind: generally real property held for investment or business use, for real property
  • Qualified intermediary: you can't touch the money in between
  • Equal or greater: buying equal or greater value and reinvesting all proceeds generally defers the most tax
